BACKGROUND AND PURPOSE 

Under current law, a sheriff is required to complete the initial
requirements to carry a handgun upon retirement in order to continue
carrying a handgun.  The law does not provide for completion of the
requirements after retirement.  Senate Bill 483 provides for completion of
the requirements to carry a handgun for retired sheriffs.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

Senate Bill 483 amends the Penal Code to specify that the provision
prohibiting the carrying of a handgun does not apply to a person who is an
honorably retired sheriff.  The bill sets forth the criteria for the
determination of honorable retirement, an establishes that an honorably
retired sheriff is not exempt from the Private Investigators and Private
Security Agencies Act.   

The bill amends the Government Code to require the Department of Public
Safety to allow a retired sheriff a reasonable opportunity to demonstrate
the weapons proficiency required as a criteria for honorable retirement.   

EFFECTIVE DATE

September 1, 2001.
