DIGEST AND PURPOSE 

Currently, juvenile probation personnel employed by a political subdivision
are designated state employees for purposes of Chapter 104, Civil Practice
and Remedies Code, while the members of a juvenile board are not.  As
proposed, S.B. 486 requires the state to indemnify juvenile board members
in the same manner and under the same conditions that it indemnifies an
officer of a state agency. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 152A, Human Resources Code, by adding Section
152.0013, as follows: 

Sec. 152.0013.  INDEMNIFICATION BY STATE.  Requires the state to indemnify
a juvenile board member in the same manner and under the same conditions
that it indemnifies an officer of a state agency under Chapter 104 (State
Liability for Conduct of Public Servants), Civil Practice and Remedies
Code. 

SECTION 2.  Makes application of this Act prospective.

SECTION 3.  Effective date:  September 1, 2001
