BACKGROUND AND PURPOSE

State agencies that receive over $175 million in general appropriations are
required to post certain information on the Internet. However, current law
does not expressly authorize state agencies to post information on the
Internet. Senate Bill 497 authorizes a state agency to post on an Internet
site any nonconfidential information related to the programs, activities,
or functions of the agency.

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.

ANALYSIS

Senate Bill 497 amends the Government Code to authorize each state agency
that maintains a generally accessible Internet site or for which a
generally accessible Internet site is maintained to post on the site any
nonconfidential information related to the programs, activities, or
functions of the agency.

EFFECTIVE DATE

September 1, 2001.
