HBA-JEK S.B. 535 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 535 By: Carona Human Services 5/4/2001 Engrossed BACKGROUND AND PURPOSE Under current law, the Texas Department of Human Services is scheduled to become the Texas Department of Aging and Disability Services in 2003. The Texas Department on Aging will be abolished and all of its powers, duties, functions, and activities will be transferred to the Texas Department of Aging and Disability Services. Senate Bill 535 continues the Texas Department on Aging as a single state agency for two additional years. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 535 amends law to change to September 1, 2005, the date on which the Texas Department of Human Services (DHS) becomes the Texas Department of Aging and Disability Services (ADS), and the Texas Department on Aging is abolished and its powers, duties, functions, and activities are transferred to ADS. The bill amends the Human Resources Code to provide for the continuation of the Texas Department on Aging until September 1, 2006. The bill requires the commissioner of health and human services no later than January 1, 2003, to identify the functions of the Texas Department on Aging, recommend functions that could be transferred to DHS, evaluate the degree of coordination between the Texas Department on Aging and DHS, and report the findings to the legislature. EFFECTIVE DATE September 1, 2001.
