SRC-CTC S.B. 535 77(R)BILL ANALYSIS Senate Research CenterS.B. 535 By: Carona Health & Human Services 5/28/2001 Enrolled DIGEST AND PURPOSE The Texas Department on Aging is scheduled to be abolished in 2004 and all powers, duties, functions, and activities performed by the Texas Department on Aging are to be transferred to the Texas Department of Aging and Disability Services. S.B. 535 continues the Texas Department on Aging as a single state agency until September 1, 2006. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2.12, Chapter 1505, Acts of the 76th Legislature, Regular Session, 1999, to provide that this article takes effect September 1, 2005, rather than 2003. SECTION 2. Amends Section 101.002, Human Resources Code, to provide that the Texas Department on Aging is abolished and this chapter expires September 1, 2006, rather than September 1, 2004, unless continued in existence as provided by the Texas Sunset Act (Chapter 325, Government Code). SECTION 3. Requires the commissioner of health and human services, not later than January 1, 2003, to take certain actions. SECTION 4. Effective date: September 1, 2001.
