SRC-CTC C.S.S.B. 535 77(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 535 77R13179 KKA-DBy: Carona Health & Human Services 4/20/2001 Committee Report (Substituted) DIGEST AND PURPOSE Currently, the Texas Department on Aging is scheduled to be abolished in 2004 and all powers, duties, functions, and activities performed by the Texas Department on Aging are to be transferred to the Texas Department of Aging and Disability Services. C.S.S.B. 535 continues the Texas Department on Aging as a single state agency until September 1, 2006. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2.12, Chapter 1505, Acts of the 76th Legislature, Regular Session, 1999, to provide that this article takes effect September 1, 2005, rather than 2003. SECTION 2. Amends Section 101.002, Human Resources Code, to provide that the Texas Department on Aging is abolished and this chapter expires September 1, 2006, rather than September 1, 2004, unless continued in existence as provided by the Texas Sunset Act (Chapter 325, Government Code). SECTION 3. Requires the commissioner of health and human services, not later than January 1, 2003, to take certain actions. SECTION 4. Effective date: September 1, 2001. SUMMARY OF COMMITTEE CHANGES Amends As Filed S.B. 535, as follows: SECTION 1. Removes the proposed repeal of Article 2, Chapter 1505, Acts of the 76th Legislature, Regular Session, 1999 (Long-Term Care Services; Department of Aging and Disability Services). Amends the effective date in Section 2.12, Chapter 1505, Acts of the 76th Legislature, Regular Session, 1999. SECTION 2. Continues the Texas Department of Aging until September 1, 2006, rather than 2013. SECTION 3. Adds proposed text relating to certain actions required of the commissioner of health and human services. SECTION 4. Redesignates SECTION 3 as SECTION 4.
