HBA-CBW S.B. 587 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 587 By: Duncan State Affairs 5/5/2001 Engrossed BACKGROUND AND PURPOSE Currently, state agencies face considerable challenges in recruiting and retaining qualified employees. A strong economy and changing worker attitudes have increased turnover among state employees. Nearly 18 percent of state workers left their jobs in fiscal 1999, and the turnover is much higher in some critical areas, such as human services, criminal justice, and information technology. Under current law, there are length of employment and compensation amount constraints on a retired state employee who is reemployed by a state agency. Senate Bill 587 removes these constraints and requires state agencies to conduct strategic staffing analysis and develop workforce plans to address critical staffing, training, and knowledge transfer needs. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 587 amends the Government Code to require a state agency, as part of its strategic plan, to conduct a strategic staffing analysis and develop a workforce plan, according to guidelines developed by the state auditor, to address critical staffing and training needs of the agency, including the need for experienced employees to impart knowledge to their potential successors. The bill removes provisions relating to salary, annuity, and contract payment limitations for a retired state employee who is reemployed by or contracts with a state agency. EFFECTIVE DATE September 1, 2001.
