SRC-MWN S.B. 592 77(R) BILL ANALYSIS Senate Research Center S.B. 592 By: Lindsay Education 2/22/2001 As Filed DIGEST AND PURPOSE Currently, students who have financial need or are limited in English proficiency qualify to attend prekindergarten under Section 29.153(b), Education Code. Parents of children who do not qualify are unable to enroll their children even if they are willing to pay tuition. As proposed, S.B. 592 allows school districts to expand pre-kindergarten classes to parents wishing to pay tuition for their children to attend. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 25A, Education Code, by adding Section 25.005, as follows: Sec. 25.005. TUITION FOR CERTAIN CHILDREN ATTENDING PREKINDERGARTEN. Authorizes a school district, notwithstanding any other provision of this code, if the school district has adopted a policy for admitting a child younger than five years of age who is not eligible for enrollment under Section 29.153(b), to charge tuition for the attendance of that child. Requires a tuition charge under this section to be submitted to the commissioner of education (commissioner) for approval. Provides that the attendance of the child is not counted for purposes of allocating state funds to the district. SECTION 2. Provides that this Act applies beginning with the 2001-2002 school year. SECTION 3. Effective date: upon passage or September 1, 2001.
