SRC-JBJ S.B. 609 77(R)BILL ANALYSIS Senate Research CenterS.B. 609 By: Bernsen State Affairs 6/15/2001 Enrolled DIGEST AND PURPOSE State employees who work state or federal holidays are entitled to compensatory time off during the 12 months after the holiday, but not if the holiday falls on a Saturday or Sunday. Peace officers who are state employees frequently must work holidays such as Christmas and the Fourth of July. If these holidays fall on a weekend day, the employee cannot receive compensatory time for that work unless the hours worked exceed 40 hours in work week. S.B. 609 entitles a state employee who is a peace officer commissioned by the Department of Public Safety to receive one hour of compensatory time for each hour worked on a state or federal holiday if the holiday falls on a Saturday or Sunday. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 662.005, Government Code, by adding a new Subsection (b) and redesignating previous Subsection (b) as Subsection (c), to provide that except as provided by Section 662.010, and notwithstanding Section 659.015 or another law, a state employee who is a peace officer commissioned by the Department of Public Safety and who is required to work on a national or state holiday that falls on a Saturday or Sunday is entitled to compensatory time off at the rate of one hour for each hour worked on the holiday. SECTION 2. Effective date: September 1, 2001.
