HBA-TBM C.S.S.B. 609 77(R) BILL ANALYSIS Office of House Bill AnalysisC.S.S.B. 609 By: Bernsen Appropriations 4/27/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE Current law provides compensatory time for state employees who work national or state holidays that do not fall on a Saturday or Sunday. Unlike most state employees, Saturdays and Sundays are regular work days for peace officers commissioned by the Department of Public Safety (DPS troopers). As a result, DPS troopers do not receive compensatory time for holidays that fall on weekends. C.S.S.B. 609 entitles DPS troopers to compensatory time for work performed on state or national holidays that fall on a Saturday or Sunday. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.S.B. 609 amends the Government Code to provide that a peace officer commissioned by the Department of Public Safety who is required to work on a national or state holiday that falls on a Saturday or Sunday is entitled to compensatory time off at the rate of one hour for each hour worked on the holiday. EFFECTIVE DATE September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.S.B. 609 differs from the original by limiting the provision to only peace officers commissioned by the Department of Public Safety.
