SRC-MKV S.B. 637 77(R)BILL ANALYSIS Senate Research CenterS.B. 637 By: Armbrister Natural Resources 7/5/2001 Enrolled DIGEST AND PURPOSE Section 431.003 of the Transportation Code restricts navigation districts to conducting business strictly within the boundaries of the enacting legislation, while cities and counties have a broader authority. S.B. 637 amends the Transportation Code to allow navigation districts and public port authorities to form local government corporations to "sell their expertise" in the development and operations of other ports. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 431.003(3), Transportation Code, to redefine "local government" to include a navigation district, for purposes of Subchapter D. SECTION 2. Amends Section 431.101, Transportation Code, by adding Subsection (g) to require a local government corporation created by a navigation district to comply with all state law related to the design and construction of projects, including the procurement of design and construction services, that applies to the navigation district that created the corporation. SECTION 3. Amends Section 431.101, Transportation Code, by adding Subsection (h) to prohibit a local government corporation formed by a navigation district from condemning a right-of-way through any part of a municipality without the consent of the municipality's governing body. SECTION 4. Effective date: upon passage or September 1, 2001.
