DIGEST AND PURPOSE 

Currently, the Texas Board of Chiropractic Examiners (board) must
administer the required examination of the National Board of Chiropractic
Examiners in writing.  C.S.S.B. 651 allows the board to administer the
National Board of Chiropractic Examiners examination by computer and
codifies current board rule that allows the National Board of Chiropractic
Examiners to administer the practical portion of the exam for the board. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 201.304(a), Occupations Code, to redefine the
items an applicant must complete in order to receive a license.  Deletes
wording relating to the types of examinations an applicant must pass in
order to receive a license. 

SECTION 2.  Amends Section 201.305, Occupations Code, to require an
examination given under Section 201.304(a)(1) to be conducted on practical
and theoretical chiropractic and in certain subject areas.  Deletes wording
relating to the requirement that each examination for a license to practice
chiropractic be conducted in writing and that each applicant examined at
the same time be given identical questions.  Deletes wording relating to
where an examination may be obtained and the validation of an examination. 

SECTION 3.  Amends Section 201.306, Occupations Code, to require the Texas
Board of Chiropractic Examiners (board) to notify each applicant of the
result of certain examinations.  Deletes wording relating to the grading or
reviewing of an examination by a national testing service.  Requires the
board to review with, rather than provide to, a person who fails a certain
examination the circumstances surrounding the adverse score.  Sets forth
the conditions for an applicant to pass the examination under Section
201.304(a)(2) and deletes wording relating to the requirement to grant a
license to practice chiropractic if the person scores a certain grade.
Requires specific documents from certain examinations to be preserved in
the executive office of the board for at least one year. 

SECTION 4.  Amends Section 201.307, Occupations Code, to delete wording
relating to the authorization of an applicant who fails to pass a required
examination to take another examination. Deletes wording relating to the
board determining the grade to be given an applicant.  Makes conforming
changes. 

SECTION 5.  Effective date: September 1, 2001.
  Makes application of this Act prospective.

SUMMARY OF COMMITTEE CHANGES

 SECTION 2.  Amends As Filed S.B. 651 by changing the section under which
an examination is required to be given. 

SECTION 3.  Amends As Filed S.B. 651 to clarify certain requirements of the
board relating to an examination given by the board.
