HBA-CMT S.B. 671 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 671 By: Jackson Public Safety 4/4/2001 Engrossed BACKGROUND AND PURPOSE During the 76th Legislature, the requirement that the Department of Public Safety (DPS) demand the surrender of a suspended or revoked driver's license was revised to an authorization, while the misdemeanor offense for the possession of a suspended, revoked, or canceled license remained, creating an inconsistency. Senate Bill 671 provides that a person commits a Class B misdemeanor if the person fails or refuses to surrender a license demanded by DPS. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 671 amends the Transportation Code to provide that on the cancellation or disqualification of a driver's license by the Department of Public Safety (DPS), DPS may require the holder to surrender the license to DPS. The bill provides that a person commits a Class B misdemeanor if the person's license has been suspended, canceled, disqualified, or revoked and demanded by DPS and the person fails or refuses to surrender the license to DPS. EFFECTIVE DATE September 1, 2001.
