SRC-MKV, C.S.S.B. 672 77(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 672 By: Jackson Business & Commerce 2/28/2001 Committee Report (Substituted) DIGEST AND PURPOSE Currently, the Lou Lawler Seafarers' Center is unable to serve alcoholic beverages to the seamen who stay there because the city of Morgan's Point in which it is located recently voted to become a dry municipality. C.S.S.B. 672 makes it possible for the center as a non-profit organization to obtain a private license without having to pay extra costs and fees normally associated with a private club. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 32.11 (a)(1), Alcoholic Beverage Code, to redefine "fraternal organization" to include a chapter, member, or other local unit of an American National fraternal organization that promotes the moral, educational, social and recreational welfare of merchant seafarers and that, as owner, lessee, or occupant, has operated an establishment for such fraternal purposes for at least one year. Requires the fraternal organization to meet certain requirements. SECTION 2. Effective date: upon passage or September 1, 2001. SUMMARY OF COMMITTEE CHANGES Differs from original by amending the relating clause to add the words "that are" to clarify the language and in SECTION 1 amends the reference to the Alcoholic Beverage Code. Also differs from original to clarify the transition from Subdivision (D) to Subdivision (E) by adding the word "or" to the end of Subdivision (D).
