SRC-MKV S.B. 751 77(R) BILL ANALYSIS Senate Research Center S.B. 751 77R4274 SGA-DBy: Shapleigh Health & Human Services 2/28/2001 As Filed DIGEST AND PURPOSE Currently, Medicaid reimbursement is not available for the health-related services provided by promotoras to Medicaid patients. S.B. 751 directs the Texas Department of Health to seek permission from the Health Care Financing Administration to amend the state Medicaid plan to allow the federal payment for and reimbursement of the cost of promotoras for the health-related services that they deliver to participants. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 32.024, Human Resources Code, by adding Subsection (x), to require the Health and Human Services Commission or an agency operating part of the medical assistance program to provide the services of a promotora as defined by Section 48.001, Health and Safety Code, as needed to a person under the medical assistance program. SECTION 2. Requires that, if before implementing any provision of this Act a state agency determines that a waiver or authorization from a federal agency is necessary for implementation, the state agency request the waiver or authorization and authorizes the delay of implementation of that provision until the waiver or authorization is granted. SECTION 3. Effective date: September 1, 2001.
