SRC-MKV, S.B. 755 77(R) BILL ANALYSIS Senate Research Center S.B. 755 77R2688 CAS-DBy: Bivins Education 2/22/2001 As Filed DIGEST AND PURPOSE Currently, there is concern about a teacher preparing students for the Texas Assessment of Academic Skills test (TAAS) and then the same teacher administering the tests to her students, and there is no law that requires that a different teacher administer the test. S.B. 755 requires tha the teacher administering the TAAS not be the same as the teacher who performed the preparation. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 39.023, Education Code, by adding Subsection (d), to prohibit a teacher from administering an assessment instrument prescribed under Subsection (a), (b), (c), or (l) to a student the teacher has assisted in preparing for the assessment instrument. SECTION 2. Provides that this Act applies beginning with the 2001-2002 school year. SECTION 3. Effective date: upon passage or September 1, 2001.
