HBA-JEK S.B. 803 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 803 By: Haywood Transportation 4/22/2001 Engrossed BACKGROUND AND PURPOSE The Texas World War II Historical Monument Fund has been collecting funds to construct and maintain a monument at the Texas Department of Transportation (TxDOT) Welcome Center on IH-35 just north of Gainesville to honor the 103rd division of the United States Army. The area was previously the location of Camp Howze, the training camp of the103rd division before serving in Europe during World War II. Senate Bill 803 requires TxDOT to permit a private organization formed for the purpose to erect the monument, and authorizes TxDOT to accept the monument as a gift. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 803 amends the Transportation Code to require the Texas Department of Transportation (TxDOT) to permit a private organization formed for the purpose to erect a monument at the Texas travel information center near Gainesville to honor the men and support units of the 103rd division of the United States Army who served during World War II. The bill authorizes TxDOT to accept the monument as a gift and to accept grants or donations to assist in financing the monument's maintenance. The bill authorizes TxDOT to spend funds to erect and maintain the monument. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
