SRC-CTC S.B. 836 77(R) BILL ANALYSIS Senate Research Center S.B. 836 77R4335 JMM-DBy: Shapleigh Business & Commerce 3/26/2001 As Filed DIGEST AND PURPOSE In 1999, the 76th Legislature passed S.B. 1391 directing the Texas Workforce Commission (TWC) to compare TWC's current child care funding with one that would emphasize providing child care funding to areas with the greatest need. Prompted by concern over TWC's use of a mandated allocation formula which bases funding on the population of children under five, without regard to poverty, the report released by TWC substantiated the claim that certain child care funds are not allocated in a way that maximizes the delivery of this funds to children in poverty. As proposed, S.B. 836 requires TWC to allocate child care funds only through the application of a need-based formula. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 302.062(b), Labor Code, to provide an exception to this subsection. Requires the Texas Workforce Commission to allocate funds for child care services through the application of a need-based formula only. SECTION 2. Effective date: September 1, 2001.
