SRC-JEC C.S.S.B. 846 77(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 846 77R4560 PAM-FBy: Cain Intergovernmental Relations 4/4/2001 Committee Report (Substituted) DIGEST AND PURPOSE Currently, a municipality with a population of 10,000 or more is authorized to deduct employee association dues from employee paychecks on the written request of the employee. C.S.S.B. 846 requires a municipality with a population of more than 50,000 to make the deduction upon the written request of the employee if the municipality already permits deductions for any purpose other than charitable contributions, health insurance, taxes, or other deductions required by law. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 141.008, Local Government Code, by amending Subsection (a) and adding Subsection (b), as follows: (a) Provides an exception as provided by Subsection (b), and stipulates than an employees' association under this subsection does not claim the right to strike. (b) Requires the governing body of a municipality with a population of more than 50,000 to make the payroll deduction described by Subsection (a) on the employee's written request and if the municipality permits deductions for purposes other than deductions for charity, health insurance, taxes, or other deductions required by law. SECTION 2. Effective date: September 1, 2001. SUMMARY OF COMMITTEE CHANGES Differs from the original by: deleting the previously proposed change in the heading of Section 141.008, Local Government Code; amending Subsection (a) and adding Subsection (b), Section 141.008, rather than adding a whole new Section 141.0081, Local Government Code; and changing the effective date clause to delete the "upon passage" stipulation.
