DIGEST AND PURPOSE 

Currently, the state contributes $7.3 million from the state highway fund
to the County and Road District Highway Fund.  This amount was established
in 1954 and has not changed since its inception. C.S.S.B. 896 creates a new
allocation formula for distribution of state funds. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 445, Local Government Code, by adding Subchapter
D, as follows: 

 SUBCHAPTER D.  SPECIAL COUNTY ROAD ASSISTANCE PROGRAM

Sec. 445.101.  SPECIAL COUNTY ROAD ASSISTANCE PROGRAM.  Requires the
comptroller, on or before October 15 of each year, to distribute to
counties money appropriated for the special county road assistance program
under this subchapter. 

Sec. 445.102.  USE OF MONEY.  Authorizes money appropriated to the program
under this subchapter to be used only for the support of the county road
system, including uses specified by Section 256.003, Transportation Code. 

Sec. 445.103.  ALLOCATION FORMULA.  Requires the comptroller to distribute
money appropriated to the program under this subchapter among the counties
by certain formula requirements. 

SECTION 2.  Amends Section 256.002, Transportation Code, by adding
Subsection (d), to prohibit the comptroller, except as provided by Section
153.503(3)(A), Tax Code, from depositing tax receipts or other money to the
credit of the county and road district highway fund. 

SECTION 3.  Effective date: September 1, 2001.

SUMMARY OF COMMITTEE CHANGES

rather than amending Sections 256.002 (b) and (c), Transportation Code.
