DIGEST AND PURPOSE 

In 1999, the 76th Legislature added Chapter 378 (Defense Base Development
Authorities) to the Local Government Code to allow the creation of a
defense base development authority by a municipality to accept title of or
operate under a lease property of a closed or realigned facility under the
federal Defense Base Closure and Realignment Act of 1990.  However, the
code only applies to a defense base which has been closed or realigned.
S.B. 911 changes the definition "defense base" to allow certain bases that
have not been closed or realigned to be taken over and managed by an
authority. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 378.001, Local Government Code, as added by
Chapter 1221, Acts of the 76th Legislature, Regular Session, 1999, to
define "base efficiency project"  and redefine "defense base." 

SECTION 2.  Amends Section 378.003, Local Government Code, as added by
Chapter 1221, Acts of the 76th Legislature, Regular Session, 1999, to
provide that an authority is created to carry out a base efficiency
project, among other duties.  Prohibits an authority created under
Subsection (a)(2) from operating a defense base that has been closed or
realigned under the Defense Base Closure and Realignment Act of 1990 (10
U.S.C. Section 2687 note) and its subsequent amendments. 

SECTION 3.  Amends Subsection (a), Section 378.008, Local Government Code,
to require the board of an authority, if consistent with the purposes for
which the authority was created under Section 378.003, to perform certain
tasks.  Includes managing the property used for a base efficiency project
among the list of duties required of the board of an authority. 

SECTION 4.  Effective date: September 1, 2001.
