SRC-BWC S.B. 932 77(R)BILL ANALYSIS Senate Research CenterS.B. 932 By: Carona Criminal Justice 5/30/2001 Enrolled DIGEST AND PURPOSE Currently under Texas law, sexual contact is defined as "any touching of the anus, breast, or any part of the genitals of another person with intent to arouse or gratify the sexual desire of another person." S.B. 932 includes conduct that is clearly meant to arouse the sexual desire of the perpetrator in the definition of sexual contact. This bill also adds new language to the Penal Code regarding indecency with a child. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 21.01(2), Penal Code, to clarify the definition of "sexual contact." SECTION 2. Amends Section 21.11, Penal Code, to provide that a person commits an offense if, with a child younger than 17 years and not the person's spouse, whether the child is of the same or opposite sex, the person engages in sexual contact with the child or causes the child to engage in sexual contact; or with intent to arouse or gratify the sexual desire of any person, causes the child to expose the child's anus or any part of the child's genitals. Defines "sexual contact." Makes nonsubstantive changes. SECTION 3. Makes application of this Act prospective. SECTION 4. Effective date: September 1, 2001.
