DIGEST AND PURPOSE 

The holder of a winery permit may sell wine to ultimate consumers for
consumption on or off winery premises and dispense free wine for
consumption on or off the winery premises if certain specifications are
met.  S.B. 965 expands the number of counties in which an authorized holder
of a winery permit may sell wine to ultimate consumers for consumption on
or off winery premises and dispense free wine for consumption on or off the
winery premises. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 16.01(d), Alcoholic Beverage Code, as follows:

(d)  Authorizes the holder of a winery permit to sell wine to ultimate
consumers for consumption on or off winery premises and dispense free wine
for consumption on or off the winery premises if the winery is located in a
county that has a population of 240,000 or more, and borders both the Gulf
of Mexico and a county that has within its boundaries all or part of an
international airport; or in a county that has a population of 20,000 or
more and has within its boundaries all or part of three or more American
viticultural areas, as recognized and defined by the United States Bureau
of Alcohol, Tobacco and Firearms. 

SECTION 2.  Effective date: September 1, 2001.
