DIGEST AND PURPOSE

Current Texas law is vague as to what constitutes overtime work. Dallas
police officers work a standard 40 hour work week and are compensated for
overtime at the rate of time and a half. As proposed, S.B. 973 codifies
that procedure, to avoid any future attempts to have Dallas police officers
work overtime without adequate compensation.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 142.0015(f), Local Government Code, to provide
that, except as provided by this section, a police officer may not be
required to work: (1) more than 40 hours during a calendar week in a
municipality that meets certain criteria; or (2) more hours during a
calendar week than the number of hours in the normal work week of the
majority of the employees of the municipality other than fire fighters and
police officers in a municipality not described by Subdivision (1).

SECTION 2. Effective date: September 1, 2001.
