DIGEST AND PURPOSE 

Currently, entities who hold elections are having an increasingly difficult
task finding individuals to work polling places on election dates.  The
Texas Election Code caps the compensation for election workers at an amount
not to exceed $6 per hour  S.B. 1023 allows the appropriate authorities
(cities, counties, school districts, and other entities) to compensate
election workers, judges, and clerks, at whatever amount is deemed
reasonable as long as the amount is at least at the federal minimum wage
level. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 32.091(a), Election Code, to provide that an
election judge or clerk is entitled to compensation for services rendered
at a precinct polling place at an hourly rate not to exceed the amount
fixed by the appropriate authority, which amount must be at least the
federal minimum hourly wage. 

SECTION 2.  Effective date: September 1, 2001.
