SRC-MWN S.B. 1028 77(R) BILL ANALYSIS Senate Research Center S.B. 1028 77R8643 TBy: Lindsay Natural Resources 3/21/2001 As Filed DIGEST AND PURPOSE Current statutory authority limits the use by the Texas Natural Resource Conservation Commission (TNRCC) of revenues collected from the motor vehicle safety inspection (MVSI) fee. As proposed, S.B. 1028 expands the use of the revenues collected from the motor vehicle safety inspection fee and increases the amount of revenues deposited to TNRCC. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 382.0622, Health and Safety Code, by amending Subsections (a), (b), and (c), to require Clean Air Act fees to be deposited in the state treasury to the credit of the clean air account and to be used to safeguard the air resources, except that $3 of each advance payment collected by the Department of Public Safety for inspection certificates for vehicles other than mopeds under Section 548.501 (Inspection Fees Generally), Transportation Code, is to be deposited in the state treasury to the credit of the operating fund account established under Section 5.237 (Operating Fund), Water Code. Requires the funds in the operating fund account to be used to safeguard the natural resources of the state as necessary to address potential or actual environmental impacts reasonably related to the activities of the fee payers under Section 548.501, Transportation Code. Requires the Texas Natural Resource Conservation Commission (commission) to request the appropriation of sufficient money to safeguard the natural, rather than air, resources of the state as provided by this chapter. Deletes text regarding the Public Safety Commission. SECTION 2. Amends Section 548.501, Transportation Code, by amending Subsection (b), to provide that if advance payment is made the conservation commission is required to pay to the Department of Public Safety (department) $3, rather than $2, for each unissued certificate that the inspection station returns to the department. SECTION 3. Effective date: September 1, 2001. Provides that the implementation of this Act is required only if the legislature appropriates the funds set out in the contingency appropriation for this Act in the General Appropriations Act, 77th Legislative Session, 2001.
