SRC-JBJ S.B. 1033 77(R) BILL ANALYSIS Senate Research Center S.B. 1033 77R6736 YDB-DBy: Ellis, Rodney Criminal Justice 3/29/2001 As Filed DIGEST AND PURPOSE Currently, the $100 fee for reinstatement of a person's suspended driver's license under an administrative license revocation proceeding is appropriated to the Department of Public Safety (department). Subsequently, the department uses a portion of the reinstatement funds to contract with the State Office of Administrative Hearings (SOAH) to conduct hearings. This puts the department in the position of collecting and holding fees procured from individuals the department is charging under revocation proceedings then using those funds to contract with SOAH to hear the case. As proposed, S.B. 1033 removes the necessity of the contract by increasing the fee to $125 and authorizing $25 of the fee to be directly appropriated to SOAH. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 524.051(a), Transportation Code, to prohibit a driver's license suspended under this chapter from being reinstated or another driver's license issued to the person until the person pays to the Department of Public Safety a fee of $125, rather than $100, in addition to any other fee required by law. Authorizes $25 of each fee collected under this subsection to be appropriated only to the State Office of Administrative Hearings to cover the costs of hearings conducted by that office under this chapter and Chapter 724. SECTION 2. Amends Section 724.046, Transportation Code, by amending Subsection (a) and adding Subsection (c), to make conforming changes. SECTION 3. Effective date: September 1, 2001. Makes application of this Act prospective.
