SRC-TBR, JBJ C.S.S.B. 1033 77(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 1033 77R11289 YDB-DBy: Ellis, Rodney Criminal Justice 4/5/2001 As Filed Committee Report (Substituted) DIGEST AND PURPOSE Currently, the $100 fee for reinstatement of a person's suspended driver's license under an administrative license revocation proceeding is appropriated to the Department of Public Safety (department). Subsequently, the department uses a portion of the reinstatement funds to contract with the State Office of Administrative Hearings (SOAH) to conduct hearings. C.S.S.B. 1033 increases the fee to $125. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 524.051(a), Transportation Code, to prohibit a driver's license suspended under this chapter from being reinstated or another driver's license issued to the person until the person pays to the Department of Public Safety a fee of $125, rather than $100, in addition to any other fee required by law. SECTION 2. Amends Section 724.046, Transportation Code, by amending Subsection (a) to make a conforming change. SECTION 3. Effective date: September 1, 2001.
