SRC-EPT, TBR S.B. 1050 77(R)BILL ANALYSIS Senate Research CenterS.B. 1050 By: Van de Putte Health & Human Services 6/14/2001 Enrolled DIGEST AND PURPOSE The Texas department of Health is responsible for conducting annual inspections of day and youth camps throughout the state. S.B. 1050 strengthens standards which camps must meet in order to be or remain licensed. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Texas Board of Health in SECTION 2 (Sec. 141.005, Health and Safety Code), of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 141.002(2) and (5), Health and Safety Code, to redefine "day camp" and "youth camp." SECTION 2. Amends Section 141.005(a), Health and Safety Code, as follows: (a) Requires a person holding a license issued under this chapter to renew the license annually by submitting a renewal application on a date determined by the Texas Board of Health (board) by rule on a form provided by the Texas Department of Health. SECTION 3. Amends Section 141.009, Health and Safety Code, as follows: Sec. 141.009. STANDARDS. Authorizes the standards to relate to records of criminal convictions of camp personnel. SECTION 4. Amends Section 141.016(c), Health and Safety Code, to prohibit the penalty from exceeding $2,000, rather than $100, a day for each violation. SECTION 5. Effective date: September 1, 2001. (b) Makes application of this Act prospective. (c) Provides that a violation that occurs before the effective date of this Act is covered by the law in effect when the violation occurred, and the former law is continued in effect for that purpose.
