SRC-TBR S.B. 1060 77(R) BILL ANALYSIS Senate Research Center S.B. 1060 77R8783 TBy: Lindsay Finance 3/20/2001 As Filed DIGEST AND PURPOSE The legislature has acknowledged the need for agencies to respond to changing priorities by allowing, through an Article IX rider, the transfer of up to 25 percent of an agency's appropriations from one strategy to another. However, the statutory restrictions placed on the various fees assessed by the Texas Natural Resource Conservation Commission (TNRCC) do not allow the agency to avail itself of the flexibility provided under the appropriations transferability provisions. As proposed, S.B. 1060 provides that the reallocation of funds would not be subject to the statutory limitations on the uses of the funds by the TNRCC RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 5F, Water Code, by adding Section 5.2351, as follows: Section 5.2351. TRANSFERABILITY OF APPROPRIATIONS. Provides that any law that provides specific purposes for which a fund, account, or revenue source may be used and expended and that restricts the use of revenues and balances is suspended to the extent that it conflicts with any provisions and the intent of appropriations made in the General Appropriations Act for any biennium authorizing the Texas Natural Resource Conservation Commission (commission) to transfer a percentage of appropriations from one appropriation item to another appropriation item. SECTION 2. Effective date: September 1, 2001.
