HBA-BSM S.B. 1064 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1064 By: Staples Juvenile Justice & Family Issues 5/3/2001 Engrossed BACKGROUND AND PURPOSE Currently, Texas law sets forth the responsibilities of the Texas Department of Protective and Regulatory Services (department) in regard to the adoption process and the legislative intent of those provisions. Senate Bill 1064 adds to current provisions that it is the intent of the legislature that the department in providing adoption services, when it is in the children's best interest, to keep siblings together and whenever possible place siblings in the same adoptive home. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1064 amends the Family Code to provide that it is the intent of the legislature that the Department of Protective and Regulatory Services in providing adoption services, when it is in the children's best interest, to keep siblings together and whenever possible place siblings in the same adoptive home. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
