SRC-SEW S.B. 1094 77(R) BILL ANALYSIS Senate Research Center S.B. 1094 77R4180 YDB-FBy: Nelson Intergovernmental Relations 3/18/2001 As Filed DIGEST AND PURPOSE Current law provides that the Denton County statutory probate court sits in the county seat or at another assigned location and that the statutory probate court is authorized to conduct docket matters at other locations in the county as determined necessary for the protection of ward or mental health respondents. As proposed, S.B. 1094 authorizes the Denton County statutory probate court judge to conduct docket matters at other locations in the county as necessary not only for the protection of certain individuals, but also as otherwise provided by law. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 25.0631(c), Government Code, to provide that the statutory probate court of Denton County sits in the county seat and is authorized to conduct docket matters at other locations in the county as the statutory probate court judge considers necessary for the protection of wards or mental health respondents or as otherwise provided by law. SECTION 2. Repealers: Sections 25.0633(b) (regarding Denton County Court at Law provisions) and 25.0634(c) and (d) (regarding Denton County Criminal Court provisions), Government Code. SECTION 3. Effective date: upon passage or September 1, 2001.
