DIGEST AND PURPOSE 

The 76th Legislature gave the county attorney in Rains County the duties
and powers of a district attorney.  Since that time, the case load in Rains
County has continued to increase.  As proposed, S.B. 1113 places the county
attorney of Rains County under the Professional Prosecutors Act, which
makes the office of county attorney a full-time position and provides that
the attorney is entitled to be compensated by the state in the manner and
amount relating to the salary paid to district attorneys. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency.  

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 45.290, Government Code, to entitle the county
attorney of Rains County to be compensated by the state in the manner and
amount fixed by general law relating to the salary paid to district
attorneys by the state.  Deletes text regarding a certain amount,
supplementation of the salary of the county attorney, and requiring the
commissioners court to continue to provide funds for the office of the
county attorney. 

SECTION 2.  Amends Section 46.002, Government Code, to insert Rains County
into the list of counties whose county attorneys performing the duties of
district attorneys are subject to this chapter. 

SECTION 3.  Effective date: September 1, 2001.
