SRC-MWN S.B. 1116 77(R) BILL ANALYSIS Senate Research Center S.B. 1116 By: Armbrister Business & Commerce 4/9/2001 As Filed DIGEST AND PURPOSE The Public Utility Commission (PUC) has been working on protocols to implement the renewable energy program. As proposed, S.B. 1116 allows a generation and transmission cooperative to be responsible for its members' cumulative total renewable obligation, if the cooperative's board elects to do so. S.B. 1116 also prohibits the PUC from requiring a generation and transmission cooperative to allocate their renewable energy resources among their members. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 39.904(b), Public Utility Regulatory Act, to require a generation and transmission cooperative, at the election of its board of directors, to be responsible for the cumulative total of its cooperative members' renewable energy requirements. Prohibits the Public Utility Commission of Texas (commission) from requiring a generation and transmission cooperative that makes the election authorized by this subsection to allocate its renewable resources between its members when such resources are nominated. Provides that this subsection does not affect the cumulative total of renewable energy resources that are the responsibility of a generation and transmission cooperative or its cooperative members in meeting their share of the state's goals for renewable energy resources. SECTION 2. Effective date: upon passage or September 1, 2001.
