DIGEST AND PURPOSE 

The Public Utility Commission (PUC) has been working on protocols to
implement the renewable energy program. C.S.S.B. 1116 allows a generation
and transmission cooperative to be responsible for its members' cumulative
total renewable obligation, if the cooperative's board elects to do so.
C.S.S.B. 1116 also prohibits the PUC from requiring a generation and
transmission cooperative to allocate their renewable energy resources among
their members. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 39.904, Utilities Code, to provide that at the
election of its board of directors, a generation and transmission
cooperative is responsible for the cumulative total of its cooperative
members' renewable energy requirements and its affiliated cooperation
members' renewable energy requirements. Prohibits  the Public Utility
Commission of Texas (commission) from requiring a cooperative that elects
under this subsection to allocate the cooperative's renewable resources
between its members or its affiliated members when those resources are
nominated. Provides that this subsection does not affect the cumulative
total of renewable energy resources that are the responsibility of a
generation and transmission cooperative, its cooperative members, or its
affiliated cooperative members in meeting their share of the state's goals
for renewable energy resources. 

SECTION 2. Effective date: upon passage or September 1, 2001.

SECTION 1. Amends as Filed S.B. 1116, Section 39.904, Utilities Code, by
deleting previously proposed Subsection (b) and replacing with Subsection
(g).
