SRC-TBR S.B. 1135 77(R) BILL ANALYSIS Senate Research Center S.B. 1135 77R2798 KSD-DBy: Carona Business & Commerce 3/23/2001 As Filed DIGEST AND PURPOSE Currently, under provisions relating to the payment of wages, the definition of "employee" does not specifically exclude an inmate. As proposed, S.B. 1135 excludes inmates and other persons in the custody of the state who provide services to a correctional facility from the definition of "employee" in provisions relating to the payment of wages. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 61.001(3), Labor Code, by redefining "employee" to not include: an inmate, defendant, releasee, or other person in the custody of the state or other governmental entity who provides services to a correctional facility, as defined by Section 1.07, (Definitions) Penal Code. SECTION 2. Effective date: September 1, 2001.
