SRC-MKV, S.B. 1144 77(R) BILL ANALYSIS Senate Research Center S.B. 1144 77R8627 PAM-DBy: Jackson Natural Resources 3/18/2001 As Filed DIGEST AND PURPOSE Galveston County gave land to the Department of Criminal Justice (TDCJ) for the purpose of expanding their Southern Regional Medical Facility in Texas City. After the expansion was complete, some of the land given to TDCJ remained unused. As proposed, S.B. 1144 allows TDCJ to give the remaining land back to Galveston County so that it may be used for the Esmond Juvenile Justice Facility, which is adjacent to the TDCJ facility in Texas City. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. (a) Requires the Texas Department of Criminal Justice, not later than January 31, 2002, to transfer to Galveston County, for consideration to which the parties mutually agree, the real property described by Subsection (d) of this section. (b) Authorizes consideration for the transfer authorized by Subsection (a) of this section to be in the form of an agreement between the parties that requires Galveston County to use the property in a manner that primarily promotes a public purpose of the state. Sets forth provisions if the consideration for the transfer is in the form of an agreement described by this subsection. (c) Requires the Texas Department of Criminal Justice to transfer the property by an appropriate instrument of transfer. Requires the instrument of transfer to include a provision that meets certain criteria, if the consideration for the transfer is in the form of an agreement described by Subsection (b) of this section. (d) Sets forth the description for the real property to which Subsection (a) of this section refers. SECTION 2. Effective date: upon passage or September 1, 2001.
