SRC-MWN S.B. 1151 77(R) BILL ANALYSIS Senate Research Center S.B. 1151 77R8054 JMM-DBy: Van de Putte Business & Commerce 4/18/2001 As Filed DIGEST AND PURPOSE Currently, the Texas Workers' Compensation Commission has a bill of rights that is not enforceable by statute. As proposed, S.B. 1151 establishes in statute the Texas Injured Workers' Bill of Rights under the Texas Workers Compensation Commission. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 401C, Labor Code, by adding Section 401.025, as follows: Sec. 401.025. OBLIGATIONS OF EMPLOYERS AND INSURANCE CARRIERS. Provides that under this subtitle, an employer has the duty to perform certain procedures. Provides that under this subtitle, an insurance carrier has the duty to perform certain procedures. Requires the Texas Workers' Compensation Commission (commission) to report to the Texas Commission on Private Security any violation of the requirement that an investigation by an insurance carrier is performed by an investigator holding the proper license or registration. SECTION 2. Effective date: upon passage or September 1, 2001.
