SRC-CTC S.B. 1165 77(R)BILL ANALYSIS Senate Research CenterS.B. 1165 By: Truan Veteran Affairs & Military Installations 5/31/2001 Enrolled DIGEST AND PURPOSE Currently, a person must complete 10 years of service as a federally recognized commissioned officer with an active unit of the Texas National Guard to be eligible for appointment as adjutant general. S.B. 1165 reduces the number of years of service required from 10 to five in order to expand the pool of candidates for adjutant general in Texas. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 431.022, Government Code, to provide that the adjutant general has the rank not to exceed lieutenant general at the discretion of the governor. Provides that federal recognition is at the rank authorized by the National Guard Bureau, not to exceed lieutenant general. SECTION 2. Amends Chapter 431B, Government Code, by adding Section 431.0221, as follows: Sec. 431.0221. ADDITIONAL REQUIREMENTS FOR ADJUTANT GENERAL. Sets forth certain requirements for an adjutant general to have completed, until September 1, 2005, notwithstanding Section 431.022(b)(3). Provides that this section expires September 1, 2005. SECTION 3. Effective date: September 1, 2001.
