SRC-MWN S.B. 1178 77(R) BILL ANALYSIS Senate Research Center S.B. 1178 By: Gallegos Education 4/2/2001 As Filed DIGEST AND PURPOSE Currently, exemptions related with the open meetings act hinder open deliberations among board of trustees of a certain independent school district. As proposed, S.B. 1178 removes the exemption to the open meetings act for a certain independent school district during deliberations by the board of trustees for the appointment of a trustee to fill a vacancy on the board. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 551.074, Government Code, by adding Subsection (c), to provide that Subsection (a) (regarding exemptions to the open meetings requirement for a governmental body deliberating the employment or opportunity of certain persons) does not apply to a deliberation by the board of trustees of an independent school district that has an enrollment of at least 195,000 students if the board is deliberating the appointment of a trustee to fill a vacancy on the board of trustees. SECTION 2. Effective date: September 1, 2001. Makes application of this Act prospective to September 15, 2001.
