DIGEST AND PURPOSE 

The Government Code requires each state agency to submit a biennial
operating plan and an agency strategic plan for information resources to
the Department of Information Resources for evaluation. S.B. 1230 amends
provisions of the Government Code to place the responsibility for
evaluating the biennial operating plans of state agencies with the
Legislative Budget Board. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 531.0273(c), Government Code, to prohibit a
health and human services agency from submitting its plans to the
Department of Information Resources or the Legislative Budget Board under
Chapter 2054E, until those plans are approved by the Health and Human
Services Commission (commission). 

SECTION 2.  Amends Sections 2054.095(c) and (d), Government Code, as
follows: 

(c)  Authorizes the Legislative Budget Board (LBB) to prescribe the format
required for an agency strategic plan. 

(d)  Authorizes the LBB to adopt instructions, consistent with Section
2054.096, that guide state agencies in the preparation of their agency
strategic plans.  Authorizes the instructions to include the general
criteria under which the LBB will evaluate the plan.  Deletes language
regarding delivery of instructions. 

SECTION 3.  Amends Section 2054.096(a), Government Code, to make a
conforming change. 

SECTION 4.  Amends Section 2054.097, Government Code, as follows:

(a)  Requires a state agency to send its strategic plan to the LBB and the
Department of Information Resources (department) for review. 

(b)  Authorizes the LBB or the department to report to the agency, the
governor, the state auditor, and the presiding officer of each house of the
legislature that an agency strategic plan or plan amendment is not best
suited to the state agency's execution of its own duty.  Deletes language
regarding approval of strategic plans, approval in writing, and reporting
the finding to the legislature. 

SECTION 5.  Amends Sections 2054.100(a) and (c), Government Code, as
follows: 

(a)  Requires each state agency to submit an operating plan to the LBB each
state fiscal  biennium in accordance with the directions of the LBB.
Deletes language requiring the plan to be submitted not later than the 30th
day after the General Appropriations Act becomes law. 

(c)  Requires an agency, not later than the date designated by the LBB in
its directions, agency to submit an amended plan to reflect new or changed
initiatives contained in the agency's legislative appropriations request. 

SECTION 6.  Amends Section 2054.101, Government Code, to make conforming
changes. 

SECTION 7.  Amends Section 2054.102, Government Code, as follows:

Sec. 2054.102.  New heading: EVALUATION OF OPERATING PLANS.  Authorizes the
LBB to specify procedures for the submission, review, approval, and
disapproval of biennial operating plans and amendments, including
procedures for review or reconsideration of LBB disapproval of a biennial
operating plan or biennial operating plan amendment. 

SECTION 8.  Amends Section 2054.103, Government Code, to make conforming
change. 

SECTION 9.  Amends Section 2054.118(a), Government Code, to make a
conforming change. 

SECTION 10.  Repealer: Section 2054.098 (Approval or Disapproval of Agency
Strategic Plan), Government Code. 

SECTION 11.  Effective date: September 1, 2001.
