SRC-MWN S.B. 1235 77(R) BILL ANALYSIS Senate Research Center S.B. 1235 By: Cain Business & Commerce 4/9/2001 As Filed DIGEST AND PURPOSE Currently, Chapter 204 of the Alcoholic Beverage Code requires the submission of a performance bond and a tax security bond from various permittees and licensees. As proposed, S.B. 1235 allows the Texas Alcoholic Beverage Commission to determine through its rulemaking authority if such bonds are required. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Texas Alcoholic Beverage Commission in SECTION 1 (Section 204.07, Alcoholic Beverage Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 204, Alcoholic Beverage Code, by adding Section 204.07, as follows: Sec. 204.07. WAIVER OF BOND REQUIREMENT. Authorizes the Texas Alcoholic Beverage Commission (commission) to waive the requirement that a licensee or permittee furnish a bond under this chapter if the commission by rule determines the submission of the bond is no longer necessary. SECTION 2. Effective date: September 1, 2001.
