SRC-CTC S.B. 1236 77(R)BILL ANALYSIS Senate Research CenterS.B. 1236 By: Cain Business & Commerce 5/23/2001 Enrolled DIGEST AND PURPOSE Currently, the Alcoholic Beverage Code authorizes a licensee to renew a permit up to 10 days after the expiration date of the license if the licensee pays an additional fee per permit and files appropriate applications. S.B. 1236 extends the grace period from 10 days to 30 days and gives the Alcoholic Beverage Commission an opportunity to advise the licensee of the expiration of the permit and the possibility of renewal. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 6.04, Alcoholic Beverage Code, to authorize the holder of a license or permit issued under this code, notwithstanding any other provision of this code, to renew the license or permit rather than reapply for an original license or permit if, not later than the 30th, rather than the 10th, day after the date of expiration of the license or permit, the holder files a renewal application and the required license or permit fee with the Texas Alcoholic Beverage Commission (commission) and pays a late, rather than a renewal fee, as provided by rules of the commission. Deletes existing text relating to the amount the renewal fee. Prohibits the holder of a license or permit who does not renew the license or permit before its expiration date from operating until the holder files an application under this section. SECTION 2. Effective date: September 1, 2001.
