SRC-MWN S.B. 1260 77(R) BILL ANALYSIS Senate Research Center S.B. 1260 77R9089 JJT-DBy: Shapleigh Education 4/3/2001 As Filed DIGEST AND PURPOSE The comptroller currently conducts "Texas School Performance Reviews" for the purpose of improving the operational efficiency of public school districts. As proposed, S.B. 1260 expands the comptroller's authority relating to school performance reviews to include general academic teaching institutions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 403.020, Government Code, as follows: Sec. 403.020. New heading: PERFORMANCE REVIEW OF SCHOOL DISTRICTS AND GENERAL ACADEMIC TEACHING INSTITUTIONS. Defines "general academic teaching institution." Authorizes the comptroller of public accounts (comptroller) to periodically review the effectiveness and efficiency of the budgets and operations of general academic teaching institutions. Authorizes a review of a general academic teaching institution to be initiated by the comptroller, by the Texas Higher Education Coordinating Board, or by the request of the institution. Authorizes a review to be initiated by a general academic teaching institution only at the request of the president of the institution or by a resolution adopted by a majority of the governing board of the institution. Requires the district or institution, if a review is initiated by the school district or general academic teaching institution, to pay 25 percent of the cost incurred in conducting the review. Requires a review of a general academic teaching institution under this section to include review of certain aspects of the institution. Requires the comptroller to file the report with certain entities and individuals. SECTION 2. Effective date: upon passage or September 1, 2001.
