SRC-JBJ S.B. 1278 77(R) BILL ANALYSIS Senate Research Center S.B. 1278 77R801 JMG-DBy: Armbrister Criminal Justice 4/12/2001 As Filed DIGEST AND PURPOSE Currently, there are provisions that govern the production and placement of the registration insignia and inspection certificate stickers. As proposed, S.B. 1278 amends these provisions to allow a person to place such stickers on either the vehicle windshield or rear window. RULEMAKING AUTHORITY Rulemaking authority previously granted to the Department of Public Safety is modified in SECTION 2 (Section 548.255, Transportation Code) of this bill. Rulemaking authority is expressly granted to the Department of Public Safety in SECTION 2 (Section 548.255, Transportation Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 502.180(d), Transportation Code, to require the registration insignia for validation of a license plate to be attached to the inside of the vehicle's windshield or rear window within six inches of the place where the motor vehicle inspection sticker is placed. Deletes existing text regarding whether a vehicle has a windshield and text regarding the requirement that vehicle inspections stickers be placed in a certain location. Makes a conforming change. SECTION 2. Amends Section 548.255(a), Transportation Code, to require the inspection certificate to be attached to the windshield or rear window of a vehicle, at the option of the vehicle's owner, in the manner required by Department of Public Safety (department) rule. Deletes existing text regarding production of an inspection certificate. Requires an inspection certificate to be produced for a vehicle in the manner required by department rule. SECTION 3. Amends Section 548.053(c), Transportation Code, to make a conforming change. SECTION 4. Amends Section 548.602(b), Transportation Code, to make a conforming change. SECTION 5. Amends Section 623.011(d), Transportation Code, to make a conforming change. SECTION 6. Amends Section 683.051, Transportation Code, to make conforming and nonsubstantive changes. SECTION 7. Effective date: January 1, 2002. SECTION 8. Requires the department, before September 1, 2001, to adopt rules providing for the manner of attachment of an inspection certificate to the windshield or rear window of a vehicle.
