SRC-JEC S.B. 1300 77(R)BILL ANALYSIS Senate Research CenterS.B. 1300 By: Cain Health & Human Services 6/19/2001 Enrolled DIGEST AND PURPOSE Current statutes are inconsistent regarding a physician who is practicing medicine without an annual registration receipt for the current year but who pays within a 30-day grace period. S.B. 1300 clarifies that a physician is not considered to be practicing medicine without a license during the 30-day grace period for payment of the annual registration fee. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 156.008(a), Occupations Code, to provide that practicing medicine after the expiration of the 30-day grace period under Section 156.004 following expiration of an annual registration receipt that has not been renewed for the current year as provided by this subchapter has the same effect as, and is subject to all penalties of, practicing medicine without a license. SECTION 2. (a) Provides that, in accordance with Section 311.031(c), Government Code, which gives effect to a substantive amendment enacted by the same legislature that codifies the amended statute, the text of Section 156.008(a), Occupations Code, as set out in Section 1 of this Act, gives effect to changes made by Chapter 1262, Acts of the 76th Legislature, Regular Session, 1999. (b) Provides that, to the extent of any conflict, this Act prevails over another Act of the 77th Legislature, Regular Session, 2001, relating to nonsubstantive additions and corrections in enacted codes. SECTION 3. Effective date: upon passage or September 1, 2001.
