SRC-MKV, SEW C.S.S.B. 1302 77(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 1302 By: Cain Intergovernmental Relations 4/11/2001 Committee Report (Substituted) DIGEST AND PURPOSE Current law requires a city to hold a citywide election for approval before selling, transferring, or conveying park land. However, some park lands are not used for a park or for recreational purposes and the expense of holding an election to approve selling or trading the land would be cumbersome. C.S.S.B. 1302 provides that legislation requiring such an election does not apply to certain park lands. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 253.001, Local Government Code, by adding Subsection (i), to provide that Subsection (b) does not apply to a conveyance of certain park lands. SECTION 2. Effective date: September 1, 2001. SUMMARY OF COMMITTEE CHANGES Differs from original in SECTION 1 by changing the language relating to park land to apply to park land that is owned by a home-rule municipality with a population of more than 625,000, rather than one million, and park land that is sold or conveyed as an interest in land to the owner of an interest in the adjoining property, rather than park land sold or conveyed as a sale to the owner of adjoining property.
