SRC-SEW S.B. 1319 77(R)BILL ANALYSIS Senate Research CenterS.B. 1319 By: Staples State Affairs 5/21/2001 Enrolled DIGEST AND PURPOSE Current law requires the secretary of state, when served with duplicate copies of process for a nonresident, to require a statement of the name and address of the nonresident's home or home office and then immediately mail a copy of the process to the nonresident. S.B. 1319 places that requirement of providing the statement of the name and address of the nonresident's home or home office for forwarding of process upon the person who submits the documents. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 17.045, Texas Civil Practice and Remedies Code, to require the documents, if the secretary of state is served with duplicate copies of process for a nonresident, to contain a statement of the name and address of the nonresident's home or home office. Requires the secretary of state to immediately mail a copy of the process to the nonresident at the address provided. SECTION 2. Effective date: September 1, 2001.
