DIGEST AND PURPOSE 

Currently, local governments are authorized to establish programs under the
Texas Community Development Act of 1975 that promote energy conservation
but are not expressly authorized to establish water conservation programs.
As proposed, S.B. 1333 authorizes local governments, the Texas Higher
Education Coordinating Board, and neighborhood enterprise associations to
promote water conservation through certain state and local programs. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 373.005(b), Local Government Code, to set forth
guidelines concerning the composition of a community development program. 

SECTION 2.  Amends Section 61.0591(c), Education Code, to require the Texas
Higher Education Coordinating Board (board) to allocate incentive funding,
as a percentage of base funding, among institutions of higher education for
the purpose of rewarding institutions and achieving goals set by the board
in relation to water conservation. 

SECTION 3.  Amends Section 2303.304(b), Government Code, to authorize a
neighborhood enterprise association to provide water conservation projects
with the approval of and in coordination with the responsible state or
local governmental entity.   

SECTION 4.  Effective date: September 1, 2001.
