DIGEST AND PURPOSE 

The dredgings from the Laguna Madre have a high saline content and may
cause some detriment to the land that it is placed on and certain habitats
protected for endangered species.  As proposed, S.B. 1356 prohibits the
Texas Transportation Commission from condemning property that is subject to
a habitat conservation plan and that is owned by a participant in the plan. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 51.005, Transportation Code, by amending
Subsection (b) and adding Subsection (d), to prohibit the Texas
Transportation Commission (commission) from taking certain actions,
including condemning property that is subject to a habitat conservation
plan and that is owned by a participant in the plan.  Defines "habitat
conservation plan." 

SECTION 2.  Effective date: September 1, 2001.
